TERMINOS Y CONDICIONES


RESERVATIONS. Clients making reservations by phone, fax, or email will be deemed to have read the booking conditions. A reservation is accepted and final only upon the date TRIP TREK PERU E.I.R.L. confirms its acceptance in writing and issues a formal confirmation. From that moment on, a binding contract between THE AGENCY and THE CLIENT comes into effect.
LA AGENCIA se reserva el derecho de rehusar una reserva sin necesidad de ofrecer una explicación.
El contrato es entre LA AGENCIA y EL CLIENTE. La persona que firme el CONTRATO DE PRESTACION DE SERVICIOS avala que está plenamente autorizada por todas las personas nombradas en dicho formulario, y confirma que tales personas están plenamente informadas sobre las condiciones y que las aceptan. Las reservas serán confirmadas mediante un abono del 50% del valor total del paquete. El saldo deberá ser pagado, a más tardar, un día antes del inicio del viaje. Todo paquete que se adquiera con menos de 2 días de la fecha de salida deberá ser pagado en su totalidad al momento de la reserva.

ENDORSEMENT. If a member of your party cannot travel, the reservation may be transferred to another appropriate person, provided written notification is given at least three days before departure. Passengers may endorse their voucher, under their own responsibility, after providing written notice, signed by them, and notifying the person to whom they are transferring.
Puede haber cobros adicionales para cubrir los costos impuestos por los proveedores de LA AGENCIA. Entradas para el Parque nacional Huascarán, entre otras, no son reembolsables ni son transferibles.
NO SHOW. En caso de que, un pasajero no se presente al inicio del tour, la empresa asumirá su no participación en la totalidad de los tramos reservados. Sin embargo, el pasajero podrá integrarse al grupo en un punto intermedio del viaje, sin derecho a reembolso por los tramos no utilizados.
IMPREVISTOS Y CONTINGENCIAS. Aunque LA AGENCIA TRIP TREK PERÚ E.I.R.L. realizará sus mejores esfuerzos para operar todos sus tours como han sido promocionados, El Cliente acepta que pudiera ser necesario o aconsejable variar o modificar el itinerario de un tour o sus contenidos debido a las condiciones imperantes locales.
TRIP TREK  PERÚ E.I.R.L. se reserva el derecho a cancelar o postergar, según el caso, el TREK o parte de este, en caso de no cumplirse con las condiciones climáticas u operativas requeridas, así como eventos de fuerza mayor o caso fortuito (por ejemplo: terremotos, epidemias,

Cuando se realice una modificación importante, El Cliente tendrá la opción de aceptar el cambio de planes, comprar cualquier otro tour disponible o cancelar el tour y obtener un reembolso total, siempre que la modificación importante no sea debido a fuerza mayor. Sin embargo, en caso de fuerza mayor durante el viaje, LA AGENCIA está comprometida en brindarle al pasajero todas las facilidades y asesorías que ayuden a salvaguardar la integridad de este.

PENALTIES. The Client may cancel the reservation at any time up to 10 days before departure, provided that such cancellation has been communicated in writing.
Suppliers may charge cancellation fees to the Client, and THE AGENCY will not be responsible for these costs.
Las reservas confirmadas podrán ser anuladas mediante notificación escrita al correo de la agencia, triptrekperu@gmail.com : Up to 5 calendar days in advance of the agreed-upon date for HIGH season and 3 days in advance for MEDIUM and LOW seasons. After this time, if a partial or total cancellation of the reservation occurs, the following penalties will apply:
• Between 5 and 3 days before the trip: 30% of the total value during high season.
• Between 4 and 2 days before the trip: 50% of the total value during high season.
• Between 2 and 1 days before the trip 80% of the total value in high season.
• Less than 1 day before the trip, or at the time of pick-up, there will be no refund.
• Non-use of any of the services included in the packages will not entitle you to any refund.
In addition, for refunds of payments made by credit card, a 5% deduction applies in all cases and regardless of the cancellation date, corresponding to the operating costs applied by the system operator.

SURCHARGES. THE AGENCY reserves the right to increase the cost of a tour for the following reasons: government decisions, currency, transportation costs, including fuel costs. If the surcharge results in an increase of more than 10% of the tour cost, the Client has the right to cancel the reservation within seven (5) days after notification of the surcharge and obtain a full refund, less any non-refundable deposits paid to THE AGENCY'S suppliers. No surcharge will be imposed within 10 days of the departure date.

INFANTS AND MINORS. Infants (INF) are those who, on the date of booking, have not yet turned 3 years of age. Unless expressly stated otherwise, infants cannot participate in the Trek because it is a high-risk hike for infants. Unless their parents take them under their own responsibility, the agency will not be responsible for any harm the infant may suffer. Children (CHD) are those who, having reached 3 years of age, have not turned 10 years old on the start date of the package. Unless expressly stated otherwise, children are entitled to participate in the Trek, paying 75% of the adult fare. Infants and children must always travel accompanied by a person over 18 years of age.
RULES OF CONDUCT. Any person who, through illegal acts, hinders the completion of the Trek, violates the rules regarding the consumption of illicit substances or alcohol, or commits a crime, causes discomfort, inconvenience, damage or injury to other people, the group or any property of the Huascarán National Park, may be immediately excluded from the trip, at the discretion of the guide, who may also take all measures deemed necessary to avoid the effects of such behavior.
LOCAL LAWS. All participants in tours operated by LA AGENCIA TRIP TREK PERÚ E.I.R.L. are expected to respect the laws and regulations of the countries they visit, and any failure to do so will release LA AGENCIA from any liability for any obligations it would otherwise have under the booking conditions.
TRAVEL INSURANCE. A travel insurance policy is highly recommended for all Clients while traveling on tours organized by THE AGENCY. The Client and their personal property, including luggage, are entirely at their own risk. It is the Client's responsibility to obtain their own insurance. An appropriate insurance policy should adequately cover medical expenses that may occur due to illness or accident before or during the vacation, and the loss of vacation money due to cancellations or curtailment of the vacation for reasons covered by the insurance. The Client

PASAPORTE, VISA, TARJETA ANDINA DE MIGRACIÓN Y VACUNACIONES. It is the Client's responsibility to have a valid passport, visa permits, vaccinations, and preventive medications that may be required during the trip. THE AGENCY provides information on these and other related matters in good faith, but assumes no liability.
AGE, PHYSICAL CONDITION, AND PARTICIPATION. Se da por hecho que El Cliente, antes de hacer su reserva, se cerciore que está en condiciones físicas para realizar el itinerario que ha escogido. Se sugiere que las personas mayores de 60 años obtengan un certificado médico que está apto para viajar en el itinerario escogido. No se aceptan a menores de edad no acompañados (menos de 18 años de edad) en los tours operados por LA AGENCIA; no obstante, niños y jóvenes pueden ser aceptados siempre que estén acompañados por un padre de familia o tutor que acepte total responsabilidad por ellos. LA AGENCIA se
reserva el derecho absoluto a rehusar una reserva a su discreción. Los Clientes aceptan reconocer la autoridad y las decisiones de los empleados, líderes de tours mientras viajan con LA AGENCIA. En el caso que una de estas personas considere que la salud o la conducta de un Cliente antes o después de la salida del viaje podría peligrar el desenvolvimiento seguro, cómodo y feliz del tour, El Cliente podría ser excluido de todo o parte del tour. En el caso de mala salud, LA AGENCIA podrá realizar las gestiones que considere necesarios y recuperar del Cliente los costos de dichas gestiones.
ILLNESS OR DISABILITY. Any person suffering from an illness or disability, or undergoing treatment for any physical or medical condition, must declare the true nature of said condition at the time of booking and make arrangements to obtain any medication or other treatment they may require during the tour. This will not prevent the Client from participating in the tour, but will allow THE AGENCY to take additional precautions for the Client's safety when appropriate. Failure to disclose these conditions will result in a breach of these policies.

COMPLAINTS. If the Client has any complaint or claim regarding any tour arrangements, they must inform THE AGENCY or its representatives immediately so that a good faith effort can be made to rectify the situation. Only if THE AGENCY is aware of a problem will there be an opportunity to rectify it. Failure to file a complaint at this time will negate the Client's ability to file a claim for compensation from THE AGENCY. If a problem cannot be resolved, the complaint must be submitted in writing to THE AGENCY within two days of the tour's completion.
THE AGENCY accepts responsibility for ensuring that the Client is provided with travel that is faithful to the description in the final version of the travel program that the Client receives upon arrival, and that the services meet a reasonable standard.
THE AGENCY acts only in its capacity as agent in the event of legal conditions and, always exercising all possible caution, is not responsible for injury, illness, damage, loss, additional expenses, fortuitous delay, or other irregularities that may be caused due to intentional acts or omissions or due to negligence by companies or private individuals who supply or are involved in transportation, accommodation or other services related to the fulfillment of the tour, or due to natural disasters, social unrest or other causes.
THE AGENCY will not accept liability for any damages arising from the Client's failure to accept the authority and decisions of THE AGENCY's employees, tour leaders, and agents while traveling with THE AGENCY.
The Client who books an adventure trekking tour, including, but not limited to, trekking, camping, rafting, rock climbing, mountaineering, horseback riding, boating, etc., accepts that participation in such activities involves an element of inherent risk and personal risk. The Client releases THE AGENCY from legal liability in the event of an accident. Before embarking on these trips, the Client may be presented with a standard waiver of liability. The Client agrees that refusal to read and sign the SERVICE PROVISION CONTRACT will be considered grounds for termination of the contract.

THE AGENCY no se hará responsable por ningún extravío, robo u olvido de boletos y/o vales por servicios, THE AGENCY no se hará responsable, si algún cliente no aviso en su debido momento de su dieta en específico, vegana, vegetariana, gluten free, entre otras opciones alimentarias, THE AGENCY is not responsible for any costs in the event of a change – beyond its control – in the departure time or date of a tour, flight or other form of transportation.

RESPONSIBLE OPERATOR. The tour operator responsible for the services is TRIP TREK PERU TRAVEL AND TOURISM AGENCY E.I.R.L., with tax identification number 20612887862.
